IHC declares Islamabad Local Government Ordinance null and void for local bodies polls in Islamabad

ISLAMABAD, March 16 (Online): Islamabad High Court (IHC) has nullified Islamabad Local Government Ordinance (ILGO) in connection with local bodies elections in Islamabad.

IHC has stopped from holding local bodies polls under new ordinance instead of Local Government Act.
A single bench of IHC led by Justice Mohsin Akhtar Kayani announced the decision
The court has directed the election commission to hold local bodies polls in Islamabad under Local government Act-2015.

The court maintained in its decision local bodies polls in Islamabad cannot be held under new ordinance.

The court issued this order while announcing reserved judgment on the petitions filed by former UC chairman Sardar Mehtab, CDA Mazdoor union, CDA officers association and others.

Barrister Umar Ejaz Gillani, Qazi Adil, Kashif Malik and other lawyers gave arguments on behalf of the petitioners.
Introducing new local bodies system through ordinance in the presence of local government act was challenged in the court.

The law officer had told the court parliament session ended on November 19 and ordinance was promulgated on November 23. Objection was raised on restricting the role of chairman in local government ordinance. Question was also raised on the future of elected representatives due to non formation of ordinance as law.
