Former chairman PTI challenges contempt of EC proceedings, jail trial in LHC

LAHORE, DEC 09 (ONLINE): Former chairman PTI Imran Khan has challenged the proceedings of contempt of Election Commission (EC) case and jail trial in Lahore High Court (LHC). PTI former chairman Imran Khan has filed petition in LHC through his counsels Suleman Akram Raja and barrister Shameer Khosa.
Federal government, EC and superintendent Adiala jail have been made respondents in the petition.

The petitioner has taken plea in the petition that EC has initiated contempt of EC proceedings illegally. EC is not a court. EC has no powers to conduct contempt of EC proceedings. EC has decided to carry out jail trial in this case which is illegal. Secret trial in jail is against article 4 of the constitution.

It has been further said in the petition EC has fixed December 13, for indictment proceedings in jail.

The court has been requested through the petition to nullify EC decision for conducting jail trial. Court should issue order for open and fair trial. LHC should stop the indictment proceedings through secret trial till the final decision of the petition.

Earlier PTI had challenged EC decision of conducting intra party election again in LHC. A constitutional petition was filed by former chairman PTI in this regard. EC was made respondent in the petition.

It was said in the petition that intra party elections were conducted on June 10, 2022 as per law and constitution. EC issued illegal order for holding intra party election again within 20 days. EC order is against the law and constitution.

The court has been requested to nullify the EC order for holding intra party election again besides declaring June 10, 2022 intra party election correct.
