ISLAMABAD, Oct 08 (Online): Islamabad High Court (IHC) has remarked sealing any place by FIA at inquiry stage runs contrary to law.
IHC while declaring illegal FIA step for sealing any place at inquiry stage has ordered that DG FIA should issue directives for not sealing any place at inquiry stage.
The court also maintained FIA cannot be given license to defame citizens without legal reasons. FIA sub inspector sealed restaurant at inquiry stage without powers.
The court ordered DG FIA should hold investigation and file report thereof through MIT. Sealing any place by FIA at inquiry stage runs contrary to law. FIA misused powers which fall under misconduct. Complaint of copy rights dispute by the citizens in the name of restaurant came to FIA. FIA could not satisfy regarding style name about copy right and artistic work.
FIA officer failed to satisfy the court regarding his act of sealing the restaurant. Inquiry office r has not even written inquiry report nor has he written daily diary. FIA conduct falls out of jurisdiction. Action cannot be taken while collecting evidence in inquiry.
The case was heard by Justice Mohsin Akhtar Kiyani .
The court while ordering investigation adjourned the hearing of the case.
