SC rejects chamber appeals on the matter of cipher

ISLAMABAD, Feb 22 (Online): Supreme Court (SC) has rejected chamber appeals on inquiry on cipher related audio leaks .

Justice Qazi Faez Isa remarked let him do whose job it is. The judiciary cannot interfere in the matters of executive.

Justice Qazi Faez Isa held in chamber hearing of the appeal regarding investigation into external conspiracy cipher matter Wednesday.

Advocates Zulfiqar Bhutta, Syed Tariq Badar and Naeem ul Hassan had filed appeal pleas against objections of registrar office.

At the inception of hearing the counsel for petitioner said the inquiry regarding cipher is basic rights matter.

Justice Qazi Faez Isa remarked cipher left what impact on my and your life. There is no issue of basic rights in this case.

Justice Qazi Faez Isa remarked government can make public ciphers of entire world if it wills so. If someone other does so then he will be liable to commit violation of secret act. The Prime Minister (PM) can sever ties with the world by exercising his powers. If someone is not capable to become PM then there is also solution to it. Let him do whose job it is. Judiciary cannot interfere in the matters of executive. If former PM wanted he could constitute commission on cipher matter. If he wants now this that all the ciphers from all over the world should be sent to SC instead of foreign ministry. Will SC make declaration of war if any attack is launched in future? Is dealing with foreign affairs job of court. Who was prime minister when cipher came to open?

The counsel told the court Imran Khan was PM then. Imran Khan had waved cipher in the public meeting as PM.

Justice Qazi Faez Isa inquired PM Imran Khan had full powers for holding inquiry. Did Imran Khan take any decision to hold inquiry on this matter? All authorities are under PM. Court should do what on the matter of this cipher.

The learned judge remarked holding inquiry is the job of election commission. The judiciary cannot interfere in the matters of executive. Let him do whose job it is.

The court rejected all the three appeal pleas regarding inquiry on the matter of cipher after hearing the arguments of the lawyers.
