ISLAMABAD, March 18 (Online): Supreme Court (SC) has nullified the order for re-polling on six polling stations in Balochistan constituency No PB-50 Qilla Abdullah and ordered to hold election again therein.
The court remarked Election Commission (EC) should ensure fair and transparent election as per law and the constitution.
The order was issued on Monday.
A 3-member bench of SC presided over by the Chief Justice of Pakistan (CJP) Qazi Faez Isa took up the case for hearing Monday.
The counsel for petitioner argued the plea of EC declaring 99 percent turn out suspicious on specific polling stations is not acceptable.
Wasim Sajjad advocate said turn out remained 99 percent at several polling stations in the constituency. No order was given for re-polling therein.
Zammurd Khan of ANP had challenged EC order.
The counsel for Zammurd Khan said that re-polling was ordered in the polling stations where his client remained successful. My client Zammurd Khan had taken oath. EC suspended the notification.
There is contradiction between Forma 45 and 47 in respect of polling stations where Zammurd Khan won the election.
The CJP remarked tribunals have been set up. File the appeal therein. The court cannot hear 400 election cases. If the parties are agreed then we get hold the election again.
With the mutual consent of the parties the court later ordered to hold re-polling in the constituency.
