Noor murder case: Zahir Jaffer’s parents plea SC for bail

ISLAMABAD, Oct 06 (Online): Parents of Zahir Jaffer, main accused in Noor Mukadam murder case have resorted to Supreme Court (SC) in connection with their bail.

Zakir Jaffer, Asmat Zakir , father and mother of accused Zahir Jaffer respectively have taken plea in their appeal pleas that no reason of enmity has been attributed to Zakir Jaffer and Asmat Zakir in Noor Mukadam murder case. No such evidence are available which show that the parents were aware of intention of their son to murder Noor Mukadam. The bail plea of Zakir Jaffer and Asmat Zakr can not be rejected on the statement of any co-accused. The complete challan of Noor Mukadam murder case has not been presented in the court.

They further said that the high court transgressed its jurisdiction by ordering to complete the trial within two months. The order for completion of trial within two months is against the rights of the accused and norms of transparent trial. The right to defence of the accused will also be affected due to order for completion of trial in haste. Police investigations are based on partiality and one sidedness. The accused will not be able to defend themselves in right way if they remain in jail. It is difficult for the accused to contact their lawyers if they remain in jail. Islamabad High Court (IHC) took wrong review of section 107 of penal code of Pakistan. There are loopholes in IHC decision. Does non informing about the incident fall in abetment of crime.

They appealed to the court to nullify the IHG decision and accept their bail pleas.

The appeal pleas have been filed through advocate Khawaja Haris.

It may be mention that IHC had rejected bail plea of Zakir Jaffer and Asmat Zakir, parents of the accused Zahir Jaffer.
