Court dismisses petition seeking registration of case against PM, others over death of PTI worker in Nov 26 protest

ISLAMABAD, MARCH 22 (ONLINE): Judge Muhammad Afzal Majoka of district and sessions Court Islamabad has
dismissed petition under 22-A seeking registration of case against Prime Minister (PM) Shehbaz Sharif, interior minister others on death of PTI worker in PTI November 26 protest.

Judge Muhammad Afzal Majoka announced reserved judgment on petition under 22-A and rejected the petition filed by one Gul Khan for registration of case.
The petitioner had leveled allegation of firing against PM, Interior minister and others on protesters in November 26 protest,

The petitioner did not provide any evidence in support of his allegations in the court.
The petitioner took the plea his son was killed during firing in November 26 protest.

Earlier district and sessions court had reserved judgment on the petition seeking registration of case in connection with people killed and injured in November 26 protest.

According to media report The counsels of the petitioner and prosecutor gave arguments during the hearing of the case.
The counsel told the court during the hearing of the case basic legal rights were not given to them. The petitioner went to police station to record his statement and police arrested him illegally. Crime took place. We filed petition in this regard. Collecting record is not our job.
The counsels gave reference to decisions of superior judiciary in their support.

The counsel told the court body of son of the petitioner was given after too much difficulties and several signatures.
Court remarked we admit it that all were against you in Islamabad. Did you file any application in KP for exhumation of body.
The counsel said getting body exhumed does not fall in our powers of jurisdiction .
The court inquired had he given application to magistrate for exhumation. I have no evidence about death of person.
The lawyer told the court magistrate, justice of peace and investigating officer have their own powers. Police raised questions on applicant instead of giving reply. The PTI workers who were killed were called miscreants. See the reply of police. They have accepted our allegations. Justice of peace has to see did we go to police and give application to police.
The court inquired where is name of Mohsin Naqvi, Shehbaz Sharif and others in the application which you have read now.

The counsel replied we have written in the application documents are attached therewith. Court should accept our plea.
During the hearing prosecutor said while giving arguments they have nominated Prime Minister and others. Thanks they have not mentioned name of US president. You are leveling allegations in the petition then you should at least prove that person has died.
Prosecutor said this be decided that new application has to be given or cross version has to be got done. They have mentioned name of those persons who were killed in robbery. Trial is underway.
The court inquired has the applicant given private complaint with reference to this incident.

The counsel replied we have not given any other application. That may have been given by some one else.

It is requested to court to issue order on the basis of our statement under 164. What prosecution is saying that incident has not occurred then why they have given so many FIRs.

The court reserved judgment following completion of arguments.

Later the court rejected the petition.
