Supreme Court dismisses review petition in the matter of income tax refund

ISLAMABAD, SEP 21 (ONLINE): Supreme Court (SC) has dismissed review petition in the matter of income tax refund under special status of KP tribal areas.

The case came up for hearing before SC bench presided over by the Chief Justice of Pakistan (CJP) Qazi Faez Isa Thursday.

Riaz Hussain counsel for the petitioner took the plea notifications are there about KP government and customs refund.

The CJP Qazi Faez Isa remarked “you want there should be separate notifications for all the laws of Pakistan.

Justice Athar Minallah remarked separate notification is required to be issued only if the special status remains maintained.

The CJP remarked the petitioner lives in Pakistan and leads his life good. Then what is problem in paying a small amount of tax. When tax amount comes then roads, bridges and schools will be built in the country.

The petitioner said income tax cannot be applied in tribal areas. Therefore, he wants refund of tax amount of Rs 37 lac paid by him.

Justice Athar Minallah remarked the tribal areas have now merged into KP.
Muhammad Tahir, the petitioner who is resident of Mansehra had filed petition in 2011 in connection with refund of Rs 37 lac.

High court has suspended tax tribunal decision for refunding tax of Rs 37 lac.

The SC while upholding high court decision dismissed review petition.
