Changing of 3-member bench decision by two member bench once again reaches in SC

ISLAMABAD, SEP 20 (ONLINE): The matter of changing decision of 3-member bench of Supreme Court (SC) by 2-member bench has reached once again in SC.

Legal heirs of late Nasreen Bibi have again resorted to SC in the case of compensation of land.

Husband and four daughters of late Nasreen Bibi have filed constitutional petition taking the plea 3-memner bench of SC gave decision in their favor in 1998 and 2015. A two member bench of SC changed this decision during the course of its implementation.

The two member bench cannot change decision of three members bench. Changing the three member bench decision by two member bench is unconstitutional.

The petitioner requested the SC to nullify the two member bench decision. Order is issued for making payment of compensation of land to us as per three member bench of SC.

Land of late Nasreen Bibi was acquired by the government in 1976 in connection with Multan Bypass. As per three members bench decision compensation amounting to Rs 44 Crore was to be paid to them. According to 2-member bench decision the compensation was reduced to Rs 8 crore only.

Javed Haider husband of late Nasreen Bibi and her four daughters filed the petition.
