IHC approves bail of ice cream vendor, suspends magistrate decision

ISLAMABAD, July 26 (Online): Islamabad High Court (IHC) has approved bail of one Farmanullah, an ice cream vendor in Faisal Masjid parking besides suspending magistrate decision.

The case came up for hearing before single bench of IHC led by Justice Tariq Mehmood Jahangiri Saturday.
Barrister Umar Ijaz Gillani appeared in the court on behalf of petitioner.
The court inquired what charge has been framed.

The counsel for petitioner said no charge has been framed so far. Challan has been filed so far. My client has been declared guilty. The petitioner sets up cart in the parking of Faisal mosque to earn his livelihood. Who are erecting encroachments in the entire city, every one knows.

Justice Tariq Mehmood Jahangiri remarked do you know those people who do so. Talk about the law because charge has not been framed so far. Framing the charge is must for suspending the sentence. If charge is framed then this court can issue show cause notice.

The court inquired is the petitioner still in jail or on bail.

The counsel for petitioner said he is still in jail. No relief has been provided by the lower court to petitioner.

The court directed the counsel for petitioner to read out the decision of magistrate.

The court while issuing notices to the respondents sought reply besides ordering to release the ice cream vendor Farmanullah.
