I again say respondents should hold dialogue again: Chief Justice Pakistan

ISLAMABAD, May 15 (Online): Chief Justice of Pakistan (CJP) Umar Ata Bandial has remarked “I again say the respondents should start dialogue again.

He remarked “the institutions are under serious threat. It is my advice the respondents should play their role for peaceful environment.

He observed “see today the government is helpless. People are jumping over gate. I again say the respondents should start dialogue again. If government invites for dialogue then Ali Zafar should too talk to his party. Election Commission (EC) had not adopted this stance earlier. Can the points which were not raised earlier be raised now? It will be proper that some one else be allowed to raise these points. The EC had not raised the point of court’s jurisdiction. Federal government could raise this point. But government has not filed review petition.

He further remarked there are good points in EC petition. Some points are worth consideration. We will give decision on them. When final decision is made then we will get implement it.

He remarked look what is situation outside SC. What is going on outside then Who will get implement constitution. You can see today people are jumping over the gate. Federal government is extending support. Constitution is basis of democracy. We want peace in the country.

He observed the national institutions and assets are being set ablaze. We will see it too what is going on since the last 4 to 5 days. Despite it we are doing our job. Executive and opposition should maintain the highest norms of ethics. Implementation of constitution is must. How can the constitution be got implemented in this situation.

A 3-member bench of SC presided over by CJP took up for hearing EC review appeal plea against April 4 order Monday.

Ali Zafar counsel for PTI took the plea the review scope is limited. New points can not be raised in review petition. May 14 has passed. The constitution has passed away. The care taker governments have become unconstitutional now. The court should get implement its decision. In the prevailing situation the interim government is unconstitutional. Last week the interim government arrested former Prime Minister (PM) Imran Khan from the court.

The CJP remarked we want to hear EC stance on the maintainability of petition. We will hear provincial governments and other political parties.

The court inquired from the counsel of EC how much time is required by him to complete his arguments.

He argued review scope is not limited. The jurisdiction scope cannot be restricted in constitutional cases.

The CJP remarked we will also keep in view new points cannot be raised in review petition. There is hearing of important case with us tomorrow. As to why this hearing should not be adjourned till next week.

The court while issuing notices to Attorney General, advocate generals of Punjab and KP and other respondents adjourned the hearing of the case till next week.
