Reserved seats case: Decision of PHC, EC declared null and void

ISLAMABAD, July 12 (Online): Supreme Court (SC) has declared Peshawar High Court (PHC) decision null and void in reserved seats case besides declaring PTI entitled to reserved seats.

On March 14 a five members bench of PHC had rejected the petition against non granting reserved seats to Sunni Ittehad Council (SIC).

A 13-member full bench of SC presided over by Chief Justice of Pakistan (CJP) Qazi Faez Isa declared the Election Commission (EC) decision unconstitutional.
Justice Syed Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Yahya Afridi, Justice Aminuddin Khan, Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, Justice Ayesha A. Malik, Justice Athar Minallah, Justice Syed Hassan Azhar Rizvi, Justice Shahid Waheed, Justice Irfan Saadat Khan and Justice Naeem Akhtar Afghan are part of full court.

CJP Qazi Faez Isa told that the decision .is majority 8-5 decision.

The decision was authored by Justice Mansoor Ali Shah.

The decision said withdrawing the election symbol cannot keep political party out of elections. PTI is entitled to be granted reserved seats. PTI was and is a political party’

The court ordered reserved seats of Punjab, KP and Sindh be given to PTI.

The court while declaring PTI party in parliament and provincial assemblies said as per constitution election symbol cannot be withdrawn from any political party.

The decision said PTI could give name against reserved seats within 15 days. The remaining candidates can give certificates within 15 days they are member of this party/. .

It is pertinent to mention here that SC had reserved judgment on the case related to SIC reserved seats case.

Stringent security measures were taken inside and outside SC to maintain law and order situation.
