SC constitutional bench summons policy report from govt about Kachi abadi within two weeks

ISLAMABAD, JAN 06 (ONLINE): Supreme Court (SC) constitutional bench has summoned policy report from the federal government about Kachi abadi within two weeks in Kachi Abadi case.

Justice Amin ud Din Khan remarked the powers for regulating Kachi abadi lie with provinces and local government.

Justice Jamal Mandokhail remarked can federal government legislate on provincial powers.

He further remarked first tell us what is kachi abadi. In Balochistan all homes are made of mud bricks.

Justice Hassan Azhar Rizvi remarked Qabza groups construct kachi abadi alongside nullahs and streams. Kachi abadi houses are built on the plot of public importance . What steps have been taken by the government to stop Kachi abadis.

Counsel for CDA said first of all definition of Kachi abadi be settled. CDA has notified 10 Kachi abadis.

Justice Jamal Mandokhail remarked if there is any more possession other than these kachi abadis then we start action. Laws are in place to end illegal possession.
Counsel for CDA said court has issued stay order against retrieving possession.
Justice Muhammad Ali Mazhar remarked if there is stay order then it should be got ended. How the encroachments are made. The people of the institution too are involved in construction of encroachments. First of all “Chappar” hotel is built and then a settlement comes into existence therein.

The court while seeking report adjourned the hearing.
