Why the two officers who framed fact finding report were not made part of Special JIT: Supreme Court

ISLAMABAD, May 09 (Online): During the hearing of Arshid Sharif murder case the Chief Justice of Pakistan (CJP) Umar Ata Bandial has remarked we don’t want such reports wherein no headway has been made.

He remarked suo motu notice was taken on the matter in December 2022. Two officers presented fact finding report which contained several statements and evidences. Special JIT made no progress. When the case was fixed for hearing last week then JIT met Kenyan high commission a day before. Why no progress has been made from previous hearing till now. Why the two officers who framed fact finding report were not made part of special JIT. Supreme Court (SC) wants honest and transparent investigation into Arshid Sharif murder case.

The CJP while reprimanding Attorney General (AG) due to lack of seriousness on the part of government in the matter and non issuance of red warrants of Khurram and Waqar so far maintained we are giving last chance.

The hearing of the case was adjourned till June 13.

A five members larger bench of SC presided over by Chief Justice of Pakistan (CJP) Umar Ata Bandial took up suo motu notice case for hearing Tuesday.

Justice Mazahar Ali Naqvi remarked no progress has been made so far in Arshid Sharif murder case. Except going and coming tell us one sentence that investigation has been made. Tell us motive of JIT. No material has been given so far. What material has been collected by JIT about the murder? JIT is coming from Dubai, going to Kenya. Except this what is progress of JIT till now. In progress report Khurram and Waqar were mentioned as accused.

Justice Muhammad Ali Mazhar remarked were the red warrants of Waqar issued through Interpol.

As per report Khurram, Waqar and Tariq were looking after Arshid Sharif in Kenya. How the record will become available when there is no agreement with Kenya.

Justice Ijaz ul Ahsan remarked FIA is agency for issuing red warrants.

Attorney General (AG) told the court JIT has sent the application to FIA regarding red warrants. The MLA agreement with Kenya could not be executed with Kenya so far. Red warrants of Khurram and Waqar could not be issued.

Justice Mazahar Naqvi inquired JIT has sought phones having 20 numbers and recording of whats app calls. JIT has got these 20 numbers from where.

AG told the court these numbers were mentioned in fact finding report.

AG told the court these 20 numbers pertained to all the people who were present on the scene. Kenyan authorities have provided all these numbers. JIT will leave for Dubai and Kenya on May 17.

Justice Mazahar Naqvi remarked is there potential of recording whats app call in Kenya. There are grave concerns over seriousness of government.

Request was made by wife of Arshid Sharif for filing petition in the court to get investigates the matter from UN.

CJP directed her to be patient. We see them by giving them last chance.

The hearing of the case was adjourned till June 13.
