SCPPL case: Parliament transgresses court’s powers by enacting SCPPL: President SC Bar

ISLAMABAD, May 30 (Online): President Supreme Court (SC) Bar Abid Zubairi has filed written reply in apex court in SC Practice and Procedural bill case.

Abid Zubairi has taken plea in the reply parliament has transgressed the court’s powers by enacting Supreme Court Practice and Procedural law(SCPPL). SCPPL is in sheer breach of the constitutional principle.

Under article 191 of the constitution SC wields special powers for making amendments in the rules.

Section 6,4,2 of SCPPL relates to formation of benches. Article 6,4,2 of the law constitutes transgression of SC powers under article 191 of the constitution. The principle of distribution of constitutional powers bars parliament from transgressing court’s powers.

Article 191 should not be read separately but it should be read with other articles of the constitution related to judiciary.
