ISLAMABAD, NOV 08 (Online): Supreme Court (SC) has wrapped up bail plea of Agha Siraj Durrani being withdrawn by him.
A 3-member bench of SC presided over by the Chief Justice of Pakistan (CJP) took up the case for hearing Tuesday.
Counsel for Agha Siraj Durrani requested the court case has changed following amendment in NAB laws. Through amendment in NAB laws changes have been made in Benamidar -95-A and bail laws.
The CJP SC remarked if accountability court can grant bail then the case be not run in this court.
The CJP SC inquired if this case falls under the value of less than Rs 500 million.
The counsel for Agha Siraj Durrani said his case runs into billions of rupees. The high court decision will come on the way in accountability court. Several observations have been made in the decision of high court.
Justice Mansoor Ali Shah remarked in the presence of high court observations the case cannot go to accountability court.
The counsel for Agha Siraj Durrani told the court high court observations are with reference to previous law.
Deputy speaker NAB took the plea SC has already referred several cases to trial court.
The CJP remarked NAB amendment case is sub judice. We can not give any opinion on it.
Justice Ayesha Malik remarked the bail plea will have to be filed in lower court to benefit from amendments.
The SC while allowing to withdraw all the petitions maintained high court observations will not affect the case.
The bail plea was wrapped up being withdrawn by the petitioner.
