ISLAMABAD, FEB 09 (Online): Supreme Court (SC) has suspended Peshawar High Court (PHC) decision on deferring schedule of second phase of Local Bodies (LB) polls in KP.
The court while issuing notice to the respondents has adjourned the hearing of the case till February 14, 2022.
A two members bench of SC comprising Justice Ijaz ul Ahsan and Justice Ayesha Malik took up for hearing appeal plea filed by Election Commission of Pakistan (ECP) against Peshawar High Court (PHC) decision on deferring the second phase of LB polls in KP.
Afnan Karim Kundi counsel for ECP argued PHC Abbottabad Bench has deferred the schedule for second phase of LB polls in KP without hearing ECP. The notice for February 01 hearing of the case was received in ECP on February 02. PHC had deferred the schedule of second phase of LB polls before the notice was received by ECP. High court postponed the LB polls in 18 districts while the plea was made for deferring the LB polls in 5 districts.
The counsel for the petitioner took the plea the elections can not be held on March 27 due to weather situation.
Justice Ayesha Malik remarked how the high court gave decision this way. It should have heard the stance of ECP before giving decision. It has not been confirmed that the weather situation can hamper the election in KP.
Justice Ijaz ul Ahsan remarked ECP was to see the report of MET office and not the court. Why was PHC in so much haste to give the decision.
