SC cannot interfere in ongoing case in high court: CJP

ISLAMABAD, March13 (Online): Supreme Court (SC) has sent the matter of disqualification of federal minister Shazia Marri on the basis of fake degree to Sindh High Court (SHC).

Chief Justice of Pakistan (CJP) Umar Ata Bandial has remarked disqualification case against Shazia Marri on the basis of fake degree is already pending hearing with SHC. The SC cannot interfere in ongoing case in high court.

He observed high courts are not subordinate courts of SC. Therefore, it cannot issue directives to them.

The counsel for Kishan Chand Parwani rival candidate of Shazia Marri in 2018 general election argued Shazia Marri got transferred degree of another Shahzia resident of Liari in fake way in her name. She got issued a fake National Identity Card in her name in 2002 to prove fake degree her own genuine degree.

The CJP remarked Shazia Marri has been elected Member National Assembly (MNA) 10 times. Can this claim be made that her degree is fake after she has been elected MNA IN 2002, 2007, 2013, 2017.

Justice Ayesha Malik remarked what is the proof that Shazia Marri degree is fake.

The counsel for the petitioner said Shazia Marri date of birth earlier is 1972 then she got changed it into 1975.

The CJP remarked according to you it is beautiful incident that another Shazia Marri daughter of Atta Marri says that you got summoned by the court other Shazia Marri of Lyari.

The petitioner said the election tribunal has abolished the proceedings of disqualification against Shazia Marri.

Justice Muhammad Ali Mazhar remarked the matter of disqualification of Shazia Marri on the basis of fake degree is pending hearing in SHC. You can become respondent in the ongoing case in SHC.

The SC remarked election tribunal decision will not influence SHC decision in disqualification case against Shazia Marri.
