ISLAMABAD, May 20 (Online): Election Tribunal (ET) Islamabad High Court (IHC) while adjourning hearing of appeal pleas against polls rigging in all three constituencies of Islamabad till next week has directed to fix the cases of the three constituencies for hearing on separate days next week.
The appeal pleas against rigging in all the three constituencies including NA-46, 47 and 48 of Islamabad came up for hearing before IHC Election Tribunal (ET) Monday.
Justice Tariq Mehmood Jahangiri of IHC heard the appeal pleas.
Justice Tariq Mehmood Jahangiri has made it clear on the respondents if reply is not filed then its effects will be those which are laid down in the law.
The counsels for Election Commission (EC) have assured that they will assist the court.
Election Tribunal said that authentic copies of forms 45, 46 and 47 duly verified be filed. When certified copies come then many thing will become clear. When certified are provided by EC then it will have importance.
The counsel for PTI said it will have to be seen what tempering has been done and what we are saying. It is not possible to scrutinize them from copies.
ET said original copy will also come. Now we will summon its copies only. Every party has right to file petition and objections and we have to hear all. If you want to give arguments then all right otherwise let the verified copies come. We see them first.
Justice Tariq Jahangiri inquired who is here on behalf of Returning Officer (RO) of NA-48.
Shoaib Shaheen told no one has come so far.
Justice Tariq Jahangiri remarked on respondent is saying that they have forms 45 and they are winner. The second is also saying this. If it comes with affidavit then we see. If some one gives wrong statement then one will go to jail. For forensic we can send it to Pakistan and abroad too. When the notices of EC were received by the respondents.
Justice Tariq Mehmood Jahangiri summoned report from registrar office.
He made it clear on the respondents that if the reply is not filed then its effects will be those which are laid down in the law. Advertisement be issued to newspapers, PTV and Radio .
Returning officer is given final warning if he does not come in future then we will issue arrest warrants. Here statement will be recoded. Evidence will take place and there will be oath on the Holy Quran.
EC authorities told local commission will be set up. It will see.
ET said upon it if signatures are there on every form then how irregularity took place. All should make it clear here. We should come to know from the original documents what happened. How the evidence have been recorded.
The counsel for EC said these evidence are recorded in the presence of all candidates. Original form 45 is given. It is given to Presiding officer of EC.
ET said upon it forms 45 are held by all candidates. You will tell on oath whose form 45 is correct and whose form 45 is wrong. Whosoever gives wrong statement action will be taken against him under 193.
ET also expressed resentment over not filing reply saying 18 days were given and why reply has not come so far.
On inquiring by the court, counsel Sardar Aslam Taimore told I have been hired as counsel.
Justice Tariq remarked we are not talking of you. The rival party should have given reply soon.
Later the court adjourned the hearing of the case.
