ISLAMABAD, Jan 15 (Online): PTI has withdrawn from Supreme Court (SC) its petition on level playing field.
The PTI petition came up for hearing before SC bench Monday.
At the inception of hearing Latif Khosa, counsel for PTI while moving to the Chief Justice of Pakistan (CJP) Qazi Faez Isa said thank very much of yours.
The CJP questioned do you want to run the case or otherwise.
Counsel Latif Khosa said directives have been received for withdrawing the petition. Our more than 230 seats have been snatched from us due to your January 13 decision. We came to your court for level playing field. Such decision was announced at 11.30 pm night on January 13 that it shattered PTI. What can we expect now that level playing field will be given to us. You have powers under article 187 of the constitution. You can issue order. We don’t want to contest this case in your court. Some one of PTI candidate was allotted electoral symbol of dounga and other one was allotted glass.
The CJP Qazi Faez Isa remarked if you have to accept the decision then accept it and if you have not to accept then it is your will.
Counsel Latif Khosa said you have snatched its field from PTI. Election commission can withdraw only election symbol. Ban is being imposed on one party by keeping it out of parliament. All the candidates of PTI will contest election as independent candidates and will stand confused.
Justice Musarrat Hilali questioned from Latif Khosa does it seem to you elections are transparent.
Latif Khosa said the elections are completely unjust. We rendered sacrifices for the judiciary.
The CJP while moving to Latif Khosa said allow us to speak too. It is not proper to talk about other case in this case. Don’t shift the burden of SC decision to us.
Latif Khosa said the head of every party was kidnapped with which we forged alliance. Press conference was got done forcibly. Preparations are underway to register case against us for fostering alliance. We have been expelled out of parliamentary politics due to your decision. PTI candidate will contest election as independent candidate due to your decision. The democracy will be annihilated due to court’s decision.
The CJP remarked we have repeatedly said show us. Show us the holding of intra party election of PTI. We can do nothing if you don’t like the decision. We had issued order on level playing field. Court can issue order. It cannot become government. Police men were suspended on the matter of Barrister Gohar. Our job is to hold election as per law. We raised the matter of election. On PTI plea date was fixed within 12 days. Election commission kept on saying for holding intra party election. But they were not held. If you have objection on some other party then bring the petition.
Justice Musarrat Hilali questioned from Latif Khosa you were telling you have forged alliance with someone.
Counsel Latif Khosa replied I am telling this that we were not allowed to forge alliance.
Justice Musarrat Hilali remarked Election Commission (EC) is not fair. EC is running after a party. Does the EC not see other parties.
The CJP remarked election question arose in front of us. We got date. Could you get date. We don’t enact law. We get implement law. If you dislike law then change it.
Counsel Latif Khosa said EC returned election symbol to ANP. Why not to PTI;.
The CJP remarked we came to know a day before that time was still there as per ANP constitution. On this basis EC returned election symbol to ANP.
The CJP while moving to Latif Khosa remarked Latif Khosa sahb this is not correct procedure . You are senior lawyer. You are devastating all the institutions of Pakistan.
Later the court wrapped up PTI petition as withdrawn.
