President is not authorized to write a letter to ECP under Article 48 (5), Kanwar Dilshad

ISLAMABAD, August 24 (Online): Former Secretary Election Commission (EC) Kanwar Dilshad said that delegation of Election Commission (EC) will not meet with President.

If President of state gives date of elections then Election Commission (EC) should reject it.

While reacting to President Letter, former Chief Secretary said that President is not authorized to write a letter to EC under article 48 (5).

It is illogical for President to write a letter to EC without advice of Prime Minister (PM).

Chief Election Commissioner has the authority to set date of elections under Election Act.

Former Secretary EC said that if Supreme Court rejects notification of census then elections will be held in 90 days.

He said that Article 51 is the biggest obstacle in conducting elections in 90 days.

The power of consulting the President has been abolished under Election Act.

EC will respond to President Letter but its delegation will not meet.
