PESHAWAR, FEB 16 (Online): Peshawar High Court (PHC) has given last chance to governor Khyber Pakhtunkhwa (KP) to file reply in connection with election of KP assembly.
The petitions seeking holding of KP assembly polls in 90 days came up for hearing before a two members bench of PHC comprising Justice Ishtiaq Ibrahim and Justice Arshid Ali Thursday.
PTI leader Shibli Faraz, Shaukat Yousufzai , Shah Farman and Atif Khan appeared in the court.
Justice Ishtiaq Ibrahim while giving last chance to governor KP to file reply remarked we give time for two days. Whosoever has to file reply should file it. Who donot want to file reply they should not file. We will hear the case.
Muazaam Butt counsel for PTI said the court had sought reply from election commission and governor.
The court remarked the reply from election commission and provincial government has come to us.
Advocate General (AG) told the court he made immediate contact with the governor. He was in Mansehra. He returned last night. Reply will be filed within two days.
Justice Ishtiaq Ibrahim remarked we will hear this case on next hearing. We want to give decision on these petitions soon.
Shumail Butt counsel for PTI argued AG cannot represent governor.
The court remarked the AG has informed us about reply only. Can AG represent governor or otherwise we will see it.
The court remarked we give time of two days for filing reply. Governor should file reply within two days. We will hear the case on Monday.
The court adjourned the hearing of the case till February 20.
Shibli Faraz while talking to media men prior to hearing of the case said government and governor are dilly dallying about the election. We have come in the court for justice.
He held article 6 is applied on abrogation of constitution. Practically JUI-F government is in place in KP. What governor and care taker government are doing is illegal.
He claimed Akram Durrani is running caretaker government. The caretaker chief minister is puppet.
