LHC moved for declaring section 137(4) of election act 2017 against the constitution

LAHORE, March 30 (Online): Lahore High Court (LHC) has been moved for declaring the section 137 (4) of election act-2017 against the constitution.

The petitioner Munir Ahmad has filed the petition through Azhar Siddique advocate requesting the court to declare election act in conflict with the constitution.

Federal government and Election Commission (EC) have been made respondents in the petition.

Justice Sajid Mehmood Sethi while sending the petition to Chief Justice (CJ) LHC has said in his note the petition should be fixed for hearing before Justice Shahid Karim who had earlier heard this case. It is appropriate that the same judge should hear this petition too.

The petitioner has taken the plea EC is an administrative institution. Its mandate is to hold lelection and conduct delimitation of constituencies.

The petition further said EC can neither use judicial powers nor has it legal powers to disqualify any one directly. EC disqualified Imran Khan in Toshakhana case.Imran Khan appeal plea against EC decision is pending hearing in LHC. Now EC wants to disqualify Imran Khan from party presidentship.

The lawyer for Imran Khan requested the court to declare section 137 (4) of Election Act 2017 in conflict with the constitution. besides stopping EC from disqualifying Imran Khan from party president ship.
