Law allowing change of sex is first step towards same sex marriage: Petitioner

ISLAMABAD, Jan 17 |(Online): The petitioner has said in Federal Shariat Court (FSC) during the hearing of petitions against the law regarding grant of permission to change sex that the law allowing change of sex is first step towards same sex marriage.

He submitted it is mentioned in law that government will provide financial assistance to eunuchs. The court has to see the case in sharia perspective and NOT basic rights perspective. In some eunuchs male symptoms dominate and in some eunuchs female symptoms dominate; In the third kind of eunuchs no symptom dominates.

In Shariat one who changes one’s sex has been cursed. Sex of every child is written in birth certificate. It cannot happen so that some calls any one woman after 34 years.

Chief Justice Shariat Court remarked are eunuchs not human being that government does not extend financial assistance to them.

Justice Syed Anwar remarked who are not eunuchs they show them eunuchs. All have objection over them. Law has been enacted for the protection of rights of eunuchs. Law being the wrong and its misuse are two separate things. If someone has any objection over eunuch then the medical examination could be got done.

Justice Sheikh Qasim remarked there should be no dispute over whose sex is what.

Oria Maqbool Jan took the plea if any male wears clothes of a neither female he will neither be called female nor eunuch. Rules notification has been issued whereby permission has been given to change sex.

The eunuch Mah Noor said we cannot prove our sex by undressing ourselves before society.

The CJ remarked who has asked you to undress yourself.

The court while seeking proposals to curb fake eunuchs adjourned the hearing of the case for indefinite period.
