ISLAMABAD, Feb 14 (Online): Islamabad High Court (IHC) has summoned TORs of Commission on Enforced Disappearances (CED).
The court sought the TORs during the hearing of Mudassar Naro and other missing person’s case Monday.
The case came up for hearing before single bench of IHC presided over by Chief Justice (CJ) Athar Minallah Monday.
At the inception of hearing of the case the CJ IHC inquired has some one come from CED. The Attorney General (AG) was to give arguments.
Additional Attorney General (AAG) told the court order was received late. Commission was constituted through an order in 2010. TORs had come in 2013.
The court inquired how many persons had gone missing. What progress has been made in this regard?
AAG told the court there were 8000 cases of missing persons. 6000 cases out of these 8000 cases have been resolved. Some among them came back and some were in jails. Some have come from detention centers.
The court remarked is there any such law in place that the citizens could be lifted. Then action should be taken against the people. If they were in detention centers then what was policy of lifting the people. You should have told what happened in the incidents of enforced disappearances of the citizens last year.
The court further remarked a commission was constituted under Justice Kamal Mansoor Alam in 2010. Its report be presented. The state has to protect. If there is doubt that state is involved then who will investigate. The court is asking question that who is responsible for all these incidents. It should be determined.
Col (Retd) Inam ul Rahim advocate told the court report has come those dead bodies of 221 missing persons have been provided. It was job of commission to investigate into these incidents. How can the dead bodies be handed over.
AAG told the court a summary has been moved for cabinet meeting in the light of Mahira Sajid case.
The court inquired Attorney General can come when for giving arguments. The court can give decision. This court will give decision regarding missing persons cases.
The court while summoning Attorney General Khalid Javed Khan for arguments adjourned the hearing of the case till February 28.
