ISLAMABAD, April 28 (Online): Islamabad High Court (IHC) has reserved judgment on the petition filed by Member National Assembly (MNA) from PTI Shakoor Shad against the acceptance of his resignation.
The petition came up for hearing before single bench of IHC led by Chief Justice (CJ) Aamir Farooq Friday.
The CJ IHC during the hearing of the case remarked if we reject the petition then expenses will be incurred on re-election as much as expenses were made earlier. This is our and public money. It will be wasted.
The CJ remarked tell us “resignation or no resignation.
The counsel for Shakoor Shad told the court our stance is “no resignation”.
The court remarked earlier petitions came here that our resignations be accepted then the petitions came that the resignations were accepted wrongly.
The court inquired “have you ever told your party that resignation was obtained from you forcibly.
The counsel for Shakoor Shad told the court we have not told in writing but have told verbally several times. Shad was expelled from party for resorting to high court against resignation.
The court inquired if Abdul Shakoor Shad is receiving salary and perks.
The defence counsel told payment of salary and perks was suspended to Shad from April 2022.
The court inquired if some member violates party police then what will happen.
The defence counsel said proceedings regarding violation of party policy will be initiated but the member will not be deseated. Proceedings were initiated against Shakoor Shad regarding violation of party policy. Shakoor Shad is not part of PTI now.
The court inquired former deputy speaker accepted the resignations without summoning. The sitting speaker too accepted Shakoor Shad resignation without summoning him. The president does not verify the resignation by calling the prime minister or any judge who tenders resignation. What is wisdom of this condition in the matter of resignation of MNA?
The defence counsel said apparently the reason is this MNA represents people.
Additional Attorney General (AAG) told the court speaker had summoned Shakoor Shad for verification of his resignation.
The court remarked if Shakoor Shad had not appeared then speaker himself should have conducted inquiry. He is accepting he has tendered resignation under party pressure.
The court reserved judgment of case after hearing the arguments of the lawyers of respondents.
