Islamabad, Dec 09 (Online): Islamabad High Court (IHC) on Thursday issued pre-admission notice to Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan, election commission and all respondents for two weeks in Tyrian White matter.
IHC issued written order for hearing the petition filed by a citizen seeking disqualification of Imran Khan who was elected as MNA from Mianwali.
According to petitioner Imran Khan provided incorrect information while filing nomination papers in general election. Imran Khan made mention of two children in the details of children and concealed information about one child.
The counsel for petitioner while referring to documents tried to prove that Imran Khan has three children ’
The court sought documents from the petitioner counsel on the maintainability of the petition.
The court inquired either can high court hears the case under article 199 of the constitution or the matter should go to election commission.
The counsel for petitioner while giving court’s precedent said the court can see this matter.
The counsel said if there is factual controversy even then it is jurisdiction of court to reviewing it. Then the court can see
Pre-admission notices are issued to Imran Khan, election commission and other respondents for two weeks. The counsels for the respondents should assist the court on the maintainability of the petition on next hearing.
