ISLAMABAD, Feb 28 (Online): Election Commission of Pakistan (ECP) has dismissed PML-N Quaid Nawaz Sharif petition seeking nullification of election and re-election in NA-15 Mansehra. ECP announced decision of election petition filed by Nawaz Sharif in regard to NA-15 Mansehra. Nawaz Sharif was defeated in this constituency.
The ECP has directed Nawaz Sharif to resort to Election Tribunal (ET) besides ordering RO to compile the final result within three days.
Nawaz Sharif had demanded nullification of election in NA-15 and re-polling in the constituency.
Jahangir Jadoon counsel for Nawaz Sharif requested in ECP
that election was illegal, unconstitutional and against the election rules.
Member Election Commission (EC) Babar Hassan Bharwana inquired are you wanting to say that election in entire country was illegal, unconstitutional and rigging stricken.
Counsel for Nawaz Sharif said I am talking ONLY about NA-15.
Later the EC reserved judgment on the application.
Chief Election Commissioner (CEC) Sikandar Sultan Raja heard the election petition filed by Nawaz Sharif in respect of NA-15.
At the inception of hearing of petition Barrister Jahangir Jadoon counsel for Nawaz Sharif said report of RO has not been provided so far. He cannot give arguments without reading RO report.
Babar Awan counsel for successful candidate Gustasap Khan said RO report has been received by all. Gustasap Khan won the election with the lead of 25000. As per law recounting cannot be carried out if lead is of 25000 votes. The notification of Gustasap Khan stands suspended due to election commission order.
The CEC said on the occasion we terminate the stay. We give more time for arguments. We cannot extend stay for the sake of arguments.
Counsel Jahangir Jadoon said give us last chance for final arguments. Result of 125 polling stations has not been included in form 47.
The CEC said RO has rejected the claim of not including the result of 125 polling stations in form 47 in the report.
Babar Awan said no one on behalf of Nawaz Sharif went to RO office at the time of compilation of form 47.
