ISLAMABAD, Feb 27 (Online): The court has handed over Lt Gen (Retd) Amjid Shoaib to police on 3 days physical remand in the case pertaining to inciting people against institutions and fomenting hatred against government.
Legal team of Lt Gen (Retd) Amjid Shoaib also appeared in the court.
Prosecutor Adnan read out text of case against Amjid Shoaib in the court. Lt Gen (Retd) Amjid Shoaib was present in private TV channel program as guest. His statement fomented hatred against the government. Attempt was made to create hatred between government, opposition and government employees. The hatred is being created among three groups due to Amjid Shoaib statement. He can be sentenced to 5 years in jail due to the clauses imposed on him. The photogrammetric and voice matching test have to be got done from Lahore.
Opposing the physical remand of Amjid Shoaib, his counsel Mudassar Khalid Abbasi prayed the court to discharge the accused from the case. The court has to see if Amjid Shoaib has committed any offence or otherwise.
The counsel for the accused said if it seems to the magistrate that the accused has not committed any offence then he can be discharged from the case. Amjid Shoaib gave example with reference to a specific situation. There is no restriction on it in law. Amjid Shoaib has not said such thing so far which causes harm to country. Case against him has been instituted on political basis.
He further said Amjid Shoaib is 80 years old and he is being harassed since long. He was sent behind the bars by registering case against him within an hour. If just criticism is wrong then opposition should be excluded from the system.
Counsel Riasat Ali Azad said Amjid Shoaib has fought 1965 and 1970 wars. He is most patriotic citizen of Pakistan. Amjid Shoaib has not asked the citizens that they should not go to the offices
The court reserved the judgment on police plea for granting them the physical remand of Amjid Shoaib.
Later the court while announcing the reserved verdict handed over Amjid Shoaib to police on three days physical remand.
