26th constitutional amendment challenged in SC

ISLAMABAD, OCT 22 (ONLINE): 26th constitutional amendment has been challenged in Supreme Court (SC).

SC has been requested to declare 26th constitutional amendment null and void.

One Muhammad Anas has filed constitutional petition against 26th constitutional amendment through his counsel Adnan Khan making federation, chairman Senate, speaker National Assembly and others respondents.

The petitioner has taken the plea legislation is mandate of parliament. Parliament can make amendment in the constitution by two thirds majority. Parliament has no power to propose on court’s matters. 26th constitutional amendment is against basic structure and division of powers between the institutions.

Through 26th constitutional amendment the procedure for appointment of chief justice of Pakistan has been changed. The appointment of chief justice has gone in the hands of government following 26th constitutional amendment. The structure of Judicial Commission which appoints judges has been changed.

The petitioner prayed the court to nullify 26th constitutional amendment declaring it against the basic rights and independence of judiciary.
