Bench hearing appeal pleas against military court trials of civilians stands dissolved
ISLAMABAD, January 29 (Online): Supreme Court (SC) bench hearing intra court appeals against apex court decision on civilian trial in military courts stands dissolved.
The bench has been dissolved as Justice Sardar Tariq Masood has recused him from hearing the case.
The trial of the persons arrested in May 9 and 10 incidents will continue.
Three members judges committee will constitute new larger bench to hear intra court appeals. Justice Sardar Tariq Masood has recused from hearing the case.
A six-member Supreme Court bench led by Justice Sardar Tariq Masood started hearing the intra-court appeals on civilians’ military trials. Justice Ameenuddin Khan, Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice Musarrat Hilali and Justice Irfan Saadat are also part of the bench
The counsel for Jawad S Khawaja raised objection over bench when it started the hearing on Monday.
Counsel Khawaja Ahmad Hassan said the matter be referred to judges committee for reconstitution of the bench.
Hamid Khan counsel for Lahore Bar tried to give arguments during this time.
Upon it justice Sardar Tariq Masood remarked don’t give the arguments if we have not to hear the case. Objection is being raised that I should recuse from hearing the case. Therefore the matter is being returned to Chief Justice of Pakistan.
Later the matter was sent to Judges committee for reconstitution of the bench.
