CCP approves global logistics merger involving CMA CGM, Borusan

ISLAMABAD, Jul 22 : The Competition Commission of Pakistan (CCP) has approved the acquisition of Borusan Tedarik Zinciri Cozumleri ve Teknoloji Anonim Sirketi (“Borusan”) by CMA CGM S.A., a global player in shipping and logistics.
The proposed merger was filed and reviewed under Section 11 of the Competition Act, 2010 read with Competition (Merger Control) Regulations, 2016. The subject transaction involves the acquisition of Borusan from Borusan Holding AS and Borusan Yatirim ve Pazarlama AS, both incorporated in Türkiye, said a release issued here on Tuesday.
The CMA CGM, headquartered in France, operates worldwide in container shipping and port terminal services. In Pakistan, it is present through its logistics arm, CEVA Logistics Pakistan Pvt. Ltd and CEVA Air and Ocean Pakistan Pvt. Ltd. On the other hand, Borusan provides third-party logistics services, primarily in Türkiye, with negligible presence in Pakistan through a local agent.
The Commission, in its assessment, examined the potential anti-competitive effects of the transaction and concluded that the relevant market, freight forwarding services (air and sea), remains unaffected given the company’s limited presence in Pakistan. The transaction neither creates nor strengthens a dominant position, and it does not pose any significant entry barriers.
