AJK HC cancels 52 degrees of allotted land in ‘Shamilat’ area issued by Bhimber Senior Civil judge court

MIRPUR (AJK), Dec 12 (APP):
A judge of the Azad Jammu and Kashmir (AJK) High Court, Justice Sardar Muhammad Ijaz Khan, has cancelled 52 decrees related to land in the Shamilat area, which had earlier been issued by the Senior Civil Judge Bhimber.

According to an official handout issued by the Press Information Department of the AJK government, Senior Civil Judge Haji Raja Imtiaz had issued hundreds of kanals of Shamilat land in 2007 in favour of various individuals. These decrees were declared illegal and subsequently cancelled by the AJK High Court.

The learned High Court judge ordered the concerned AJK Revenue Department to cancel all actions taken in implementation of these decrees and to remove them from the official land records.

The court also directed the Revenue Department to immediately restore the cemetery, playground, and other public-interest areas in the unlawfully allotted Shamilat land, and to make necessary corrections in the record of rights.

Exercising powers under Section 115 of the Code of Civil Procedure, the AJK High Court further ordered the Mirpur Division Magistrate Court to submit the complete record of decrees issued in respect of the annexed lands within two months, so that the legal status of the remaining decrees could also be reviewed, the handout added.
