ISLAMABAD, August 21 (ONLINE): Supreme Court (SC) while rejecting the appeal plea of PML-N candidate Ali Gohar Baloch on the matter of recounting in NA-97 Faisalabad has maintained the National Assembly membership of Saad Ullah Baloch of PTI.
Justice Naeem Akhtar Khan Afghan has remarked SC set two principles in the decision that whenever any petition for recounting comes in time then RO cannot refuse recounting. SC described the differences in votes between both of the candidates. It is not being proved from anywhere in record that the petition for recounting of votes had come on February 9.
A two members bench comprising Justice Amin ud Din Khan and Justice Naeem Akhtar Afghan heard the petition Wednesday.
The lawyers of the respondents appeared in the court.
Justice Naeem Akhtar Afghan raised the question during the hearing ” prove it from the record the petition for recounting was filed timely with Returning Officer (RO). You are depending on the recent decision of SC. Two principles were set by SC in the decision, SC said when the application for recounting comes in time then RO cannot refuse .
The SC also described the difference of votes between both of the candidates for recounting. It is not being proved any where from the record that application for recounting had come on February 09. Date is not mentioned in the paper on which you are relying. Has the RO admitted on any forum that application for recanting had come.
Counsel for PML-N candidate Hassan Raza Pasha said RO can lie too.
Justice Naeem Akhtar Afghan remarked RO said the application for recounting is an afterthought.
