ISLAMABAD, Feb 23 (Online): PTI founder and his wife Bushra Bibi have filed appeal in District and Sessions court Islamabad against the decision in Non-Sharia nikah case. Bushra Bibi has filed appeal plea in District and Sessions Court Islamabad through her lawyers Usman Gill, Khalid Yousuf and Suleman Safdar. Federation and Khawar Manika have been made respondents in appeal plea.
The petition said the decision announced by civil judge Qudrat Ullah on January 02 runs contrary to the facts. The indictment framed against Bushra Bibi on January 16 is also against the law. The petition related to power of jurisdiction was rejected without giving any reasons. Civil court did not run the trial in correct way.
It has been said in the petition Bushra Bibi has right to file petition in connection with her discharge from the case. The complainant Khawar Manika filed complaint after six years. Petition like this was filed through another complainant earlier.
The court saw the law related to rujoo but it ignored Shariat with reference to matter of divorce.
Complainant Khawar Manika and witnesses kept on changing their statements.
It was further said in the petition that Mufti Saeed could not prove the second nikah solemnized between PTI founder and Bushra Bibi. Late filing of complaint gives rise to doubts. Civil judge too applied judicial mind wrongly .
It has been requested in the petition that trial court decision be declared null and void. Bushra Bibi be discharged from the case.
It is pertinent to mention here that PTI founder and Bushra Bibi were convicted and awarded sentence during this month in Nikah during Iddat case. Both were awarded 7 years imprisonment each . Fine to the tune of Rs lac each was imposed.
Bushra Bibi is imprisoned in Bani gala residence which was declared sub jail following her conviction in Toshakhana case.
The appeal pleas of PTI founder and Bushra Bibi will be marked today.
