Audio leaks commission case: Govt objections on bench tantamount to attack on independence of judiciary: SC

SLAMABAD, Sep 08 (Online): Supreme Court (SC) while rejecting PDM government objection to bench hearing audio leaks commission case has termed it an attack on independence of judiciary.

The former government had constituted a commission into the alleged audio leaks of Chief Justice of Pakistan Umar Atta Bandial’s mother in law, wife of Khawaja Tariq Rahim, son of former chief justice Saqib Nisar, Justice Mazahir Naqvi, Abid Zuberi and Parvez Elahi.

The chief justices of Balochistan and Islamabad high courts were included in this commission.

However Abid Zubairi challenged this commission.
Upon it the SC constituted a 5-member bench under the Chief Justice of Pakistan ( CJP) Umar Ata Bandial and comprising Justice Ijazul Ahsan, Justice Muneeb Akhtar, Justice Hasan Azhar and Justice Shahid Waheed.

SC bench held two hearings of this case and restrained the audio leaks inquiry commission from functioning.
However the former government filed a miscellaneous petition for removal of three judges from this bench on the basis of clash of interests.

The government raised objections on three judges of this bench including CJP Umar Ata Bandial, justice Ijaz ul Ahsan and Justice Muneeb Akhtar.

The court had reserved judgment on June 06 after hearing government petition whereby objection was raised on bench.
After 3 months, Justice Ijaz ul Ahsan announced this decision Friday.

The SC rejected government miscellaneous petition over raising objections on three judges.

The court while announcing short judgment declared government objections on bench an attack on independence of judiciary.

Justice Ijaz ul Ahsan while announcing the decision remarked objection on judges is tantamount to attack on court.

The court will announce detailed judgment later.
