ISLAMABAD, Oct 10 (Online): Islamabad High Court (IHC) has adjourned till Monday hearing the petition of Shehr Yar Afridi and Shandana Gulzar against MPO order.
The case came up for hearing before single bench of IHC led by Justice Babar Sattar Tuesday.
At the inception of hearing of the case, Babar Awan counsel for petitioner while giving arguments on the powers of DC regarding MPO said article 8 of the constitution says any law which violates the basic rights of the citizen is illegal. Imposition of MPO law in ICT is breach of the constitution.
Does MPO violate basic human rights or otherwise. It was alleged that no provincial status has been given to ICT and neither there is any local government. Then how is the MPO practicable. Provincial government can give powers to executive through law.
Babar Awan requested the court that using MPO by DC is arbitrary act. Stern action be taken against it.
The court while extending the order of stopping the government from arresting Shehr Yar Afridi and Shandana Gulzar in any other case summoned arguments from Babar Awan on Monday.
