Minor maid violence case: Court directs amicus curiae to file written reply

ISLAMABAD, Sep 19 (Online): Islamabad High Court (IHC) has directed amicus curiae to file their written reply on the petition seeking proceedings against Judge Asim Hafeez in minor maid violence case.

Chief Justice (CJ) IHC justice Aamir Farooq remarked this court cannot take suo motu notice. Investigation is underway and we will not interfere in it too.

He gave these remarks while hearing the case Tuesday.
The amici curiae Faisal Siddiqui, Zainab Janjua and Maryam Sultan appeared in the court.

The CJ IHC told them “I had received a letter and I have changed it into application. How can be such incidents stopped. Give proposals.

He further remarked the investigation of this case is running. We will not go into it. It is in my view this court cannot take suo motu notice.

Investigation is underway. We will not interfere in it. This proceeding is not in favor of the applicant or to award punishment to others. Court will not such thing which affects right of any one. It is not my objective to touch criminal trial or investigation. We want to give only observation that law is there but it is not being implemented. I will avoid issuing a writ because it will become a suo motu. I will dispose of case that the work is done and is not done. We can call legal bodies and say them that it is your job and do it. Investigation has reached where.

On being inquired by the CJ IHC Aamir Farooq the state counsel told the court the challan of case has been filed.

Amicus curiae Faisal Siddiqui said notice should be issued to accuse too.

The CJ IHC remarked we have issued notice earlier perhaps. If it has not been issued then we will issue it.

The court while seeking reply from amicus curiae adjourned the hearing of the case.
