ISLAMABAD, August 11 (Online): Justice Arbab Muhammad Tahir of Islamabad High Court (IHC) has recused from hearing petition filed by PTI leader Shehr Yar Afridi against his detention under 3-MPO.
The court sent the file to Chief Justice (CJ) IHC.
While recusing himself from hearing the petition Justice Arbab Muhammad Tahir remarked file is being sent to CJ office. CJ will mark the case to some other bench.
It has been said in the petition filed through Sher Afzal Marwat advocate that Shehr Yar Afridi is arrested as per DC Islamabad order under 3-MPO. Shehryar Afridi is imprisoned in Adiala jail.
Interior secretary, IG police Islamabad, district magistrate and Superintendent Adiala jail have been made respondents in the petition.
The petitioner took the plea that Shehryar Afridi was taken into custody after he came out of premises of Anti Terrorism Court ( ATC) Rawalpindi. We came to know when ascertained that Magistrate Islamabad has issued arrest warrant on August 08 under 3-MPO.
The petitioner requested the court to annul arrest made order 3-MPO besides ordering for his release.
