Supreme Court wraps up PTI chairman petition for halting Toshakhana trial

ISLAMABAD, August 04 (Online): Supreme Court (SC) has wrapped up Chairman PTI petition seeking halting of Toshakhana trial being withdrawn.
The petition came up for hearing before a 3-member bench of SC presided over by Justice Yahya Khan Afridi.

Justice Yahya Afridi inquired “tell us what is position of your case now.
The counsel for petitioner told the court yesterday high court had reserved judgment on the petition seeking transfer of case. We want Islamabad High Court decides it first.

The counsel for Election Commission (EC) also said under sub clause 8 of CRPC clause-26 trial court can not give final decision unless the plea for transfer of case is decided.

Justice Yahya Afridi remarked then all ok. We are seeing this matter above law.

The counsel for EC also admitted trial court can give no final decision unless the plea for transferring the case is decided.

SC disposed of Chairman PTI plea being withdrawn.
