LHC declares illegal Punjab care taker govt notification on not providing facilities to Umar Sarfraz Cheema in jail

LAHORE, July 14 (Online): Lahore High Court (LHC) has declared illegal Punjab caretaker government notification for not providing facilities to Umar Sarfraz Cheema in jail.
LHC has issued written decision on the petition seeking better facilities for Umar Sarfraz Cheema in jail.

The court while declaring the care taker government notification for not providing facilities to Umar Sarfraz Cheema in jail illegal has remarked Additional Chief Secretary (ACS) of Punjab has misinterpreted law.

It was further said in the decision that non providing facilities in jail to former governor Punjab Umar Sarfraz Cheema are discriminatory treatment. Jail facilities were provided to other accused of this nature. Umar Sarfaraz Cheema cannot be kept deprived of his constitutional rights.

According to state counsel the accused nominated in terror cases is not entitled to better facilities in jail.

The state counsel said following amendment in jail rules the accused nominated in terrorism cases were removed from the list of better facilities.

Robina Sultan wife of former governor Punjab had resorted to LHC for better facilities to Umar Sultan Cheema in jail.

Under the orders of court application was filed with ACS for better facilities that rejected the plea.
