Court declares petition filed against Imran Khan nikah during iddat period non maintainable

ISLAMABAD, May 13 (Online): District and Sessions Court Islamabad has declared petition pertaining to alleged illegal marriage of PTI chairman Imran Khan non maintainable.

Judge Nasar Minallah while announcing reserved judgment remarked the petition regarding nikah in iddat period does not fall in jurisdiction of this court.
Civil judge Nasar Minallah of district and sessions court Islamabad heard the case Saturday.

The counsel Raja Rizwan Abbasi argued during the hearing of the case the marriage during iddat is illegal. It is fraud to say that if we marry on first day of 2018 then Imran Khan will become Prime Minister (PM).

He said certain court’s decisions declare it illegal and some declare it zinna (adultery).

Bushra Bibi was in iddat in 2018. Divorce took place in November. If the marriage was legal then why the nikah was solemnized for second time?

The judge inquired Imran Khan nikah took place in Lahore. How can it fall in the jurisdiction of court?

The counsel for the petitioner replied if bullet hits at one place and death occurs on another place then trial can take place on both places.

He said fraud started from Bani gala and nikah took place in Lahore. Imran and Bushra Bibi kept on living in the jurisdiction of Islamabad due to fraud marriage. Nikah Khawan was also taken to Islamabad for nikah. Nikah of Bushra Bibi and Imran Khan were solemnized again in Islamabad in February 2018.

Raja Rizwan Abbasi further said marriage ceremony is fraud and nikah is illegal. Nikah during Iddat is illegal even if it takes place on the basis of prediction.

According to Sunni school of thought nikah during iddat is unlawful and great sin. The nikah can be solemnized on completion of iddat period. The iddat duration is for this purpose that differences of wife may come to end with husband.

He said talaq is lawful but it is not good act. Imran Khan was eager for becoming PM, therefore he solemnized nikah during the period of iddat.

Nikah process started from Islamabad therefore this matter falls in the jurisdiction of Islamabad court.

The court had reserved judgment after completion of arguments of Raja Rizwan Abbasi counsel for petitioner.
