Election Commission of Pakistan files review petition against SC April 04 decision

ISLAMABAD, May 03 (Online): Election Commission of Pakistan (ECP) has filed review petition against Supreme Court (SC) April 04 decision.

The SC through the petition has been requested to withdraw polling date of May 14.

The petitioner has taken plea in the petition that advantage can be taken from article 254 before expiry of period. SC used article 254 prematurely in Haji Saifullah case. The decision of SC 11-mmeber larger bench is there. Larger bench allowed advancing the election date by 4 months in the past. The articles related to holding of election should be read with each other.

The ECP further said in the petition that SC is not authorized to give date for holding polls. The court transgressed its powers by giving date.

The court can only interpret the law but cannot rewrite it. The empowered election commission is need of hour. Security and funds have not been provided.

The court has been requested to review its decision April 04 decision .
