New Reko Diq deal is legal: Supreme Court

ISLAMABAD, Dec 09 (Online): Supreme Court (SC) has remarked new Reko Diq deal is legal as the federal and provincial government has executed this agreement after obtaining opinion from experts.

The court further observed Reko Diq deal is not against the SC 2013 decision.

The verdict was pronounced by a five-member SC bench, headed by Chief Justice of Pakistan Umar Ata Bandial, on a presidential reference that sought the SC’s opinion on whether a 2013 judgement by the apex court prevented the federal and provincial governments from entering into the implementation agreement afresh.

It has been said in the decision new Reko Diq deal is legal. The federal and provincial government has reached the agreement after obtaining experts opinion. Balochistan Assembly was taken into confidence on the deal. The elected representatives of people did not raise any objection, The company assured that the laborers rights will be fully protected. Investment will be made on social projects from Reko Diq project.

The decision said Reko Diq project is not meant for an individual and it is for the entire Pakistan.

It has been said in the decision Sindh and kp governments have enacted law for the development of mineral resources. The constitution of Pakistan does not permit to go for deal regarding illegal national assets. The provinces can bring change in the laws related to minerals.

The court remarked there is no illegal thing in new Reko Diq deal. Briefing was given to Balochistan assembly about the deal. Reko Die deal is correct with reference to environment.

The court said in its short order Reko Diq deal is not opposed to the Supreme Court 2013 decision.
