LHC declares powers of EC for withdrawing election symbol from political parties in order

LAHORE, February 03 (Online): Lahore High Court (LHC) has declared powers of Election Commission (EC) for withdrawing election symbol from the political parties correct. LHC has issued written order regarding dismissal of petition against EC powers for withdrawing election symbol from political parties.

Justice Shahid Bilal Hassan has issued 18-page written order.
It has been said in the decision that section 215 of election act 2017 is not in clash with the constitution. In the light of articles, 14, 9. 17 and other articles of the constitution this section does not run contrary to constitution.
It was said in the decision as per petitioner the powers of election commission for withdrawing election symbol from political parties is in conflict with the constitution.

The petitioner prayed the court to declare section 215 of the constitution null and void.

it was further said in the decision that the petition is not maintainable. The political parties should abide by act and constitution.
The law with reference to intra party election is there in section 209 and 210 in election act 2017.

It is pertinent to mention here citizen Mian Shabbir Ismail had filed petition.
