Khula, marriage in US case: SC issues written order for dismissal of appeal of Pakistani citizen

ISLAMABAD, Jan 16 (Online): Supreme Court (SC) has issued written order pertaining to dismissal of appeal of a Pakistani citizen against khula and marriage in US case.
The order has said the woman holds citizenship of Pakistan along with US citizenship. As per record the woman went for second marriage in US after obtaining khula.

Justice Hassan Azhar Rizvi, of Supreme Court (SC) wrote 7 page decision.

According to the decision the petitioner had challenged the cancellation of nikah in Pakistan his former wife had solemnized in US.

The court said in the decision that the lady holds Pakistani citizenship alongwith US citizenship.

As per record the lady solemnized second marriage in US after obtaining Khula.

It has been further said in the decision the decision of Sindh High Court (SHC) in favor of obtaining khula is correct as per law. Former wife was dragged in legal proceedings unnecessarily. While the petitioner also tried to go for second marriage in Pakistan. Islam gives right of khula to the woman. If there is no harmony among wife and husband then Islam allows them for separation.
The court dismissed appeal of Pakistani citizen against Khula after hearing the arguments.

It is pertinent to mention here that the petitioner Sohail Ahmad had challenged SHC decision in SC.
