{"id":39113,"date":"2022-03-02T06:00:30","date_gmt":"2022-03-02T01:00:30","guid":{"rendered":"https:\/\/pni.net.pk\/en\/?p=39113"},"modified":"2022-03-02T02:05:38","modified_gmt":"2022-03-01T21:05:38","slug":"islamabad-high-court-rules-under-eighteen-marriages-unlawful","status":"publish","type":"post","link":"https:\/\/pni.net.pk\/en\/pakistan-news\/islamabad-high-court-rules-under-eighteen-marriages-unlawful\/","title":{"rendered":"Islamabad High Court rules under-eighteen marriages &#8216;unlawful&#8217;"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>ISLAMABAD \u2013 March 1 (ONLINE): The Islamabad High Court (IHC) on Tuesday declared marriage of those less than eighteen years as illegal, while hearing the plea of a complainant Mumtaz Bibi for retrieval of her 16 year old daughter.<\/p>\n<p>Judge Justice Babar Sattar on Tuesday, through written verdict ordered return of 16 year old Sawera Falak Sher to her mother Mumtaz Bibi.<\/p>\n<p>In its written statement, the High Court declared any marriage of less than eighteen years as \u2018illegal pact\u2019 and ordered the SHO of Golra police station to recover the girl from Dar-ul-Aman and return to her mother.<\/p>\n<p>Court\u2019s written order says that girl aged less than eighteen years can not marry independently, while guardians can never allow her to be indulged in any physical relationship.<\/p>\n<p>The judge also sought review of \u2018inefficient\u2019 explanation of Muslim Family Laws Ordinance by the Cabinet division and parliament.<\/p>\n<p>It is pertinent to mention here that Mumtaz Bibi had filed an FIR back in May 2021 about the abduction of her daughter.
