ISLAMABAD, JAN 20 (ONLINE): Supreme Court (SC) has issued contempt of court notice to additional registrar on the matter of non-scheduling the case related to powers of SC benches. <\/p>\n
SC while issuing show cause notice to additional registrar has sought minutes of judges committee meeting along with reply within 24 hours.
\nThe order said tell us as to why the case was not fixed for hearing today.
\nThe court summoned additional registrar judicial in person.
\nThe court order said SC office has told that judges committee has fixed the said case before constitutional bench on January 27.
\nMinutes of meeting of judges committee wherein this decision was taken have not been received in office so far. How can court’s orders be ignored in the presence of January 16, judicial order. We have also been told this all the cases related to tax before this bench were cancelled. <\/p>\n
The court was told now a research officer would resolve what cases would go to constitutional bench. Judges committee ignored judicial order.
\nThe hearing of the case was adjourned till today (Tuesday). <\/p>\n
Justice Mansoor Ali Shah senior judge of SC said he could not come to know about judges committee meeting while he is member of committee.
\nJustice Ayesha Malik has remarked cases were fixed for hearing before us. Fixed cases of the entire week before us were changed. Committee has no powers to transfer case.
\nThe matter of constitutional benches in SC and powers of regular benches came up for hearing before a three members bench of SC presided over by Justice Mansoor Ali Shah Monday.<\/p>\n
Barrister Salah ud Din appeared before the bench..
\nHe said he had come from Karachi. But the case has not been fixed for hearing today even. <\/p>\n
Justice Mansoor Ali Shah said he goes to know about this matter. Additional registrar SC Nazar Abbas should appear before the bench and tell why the case has not been fixed for hearing today.<\/p>\n
On resumption of hearing after short interval deputy registrar SC Zulfiqar Ali appeared in the court.<\/p>\n
He told the court judges committee meeting was held and it was decided in the meeting the case be fixed for hearing before constitutional bench on January 27 . <\/p>\n
Justice Mansoor Ali Shah remarked ” I am too member of Judges committee and I could not come to know about judges committee meeting while I am member of committee. <\/p>\n
Deputy registrar SC said the decision of judges committee meeting is attached with the file. <\/p>\n
Justice Ayesha Malik said cases were fixed for hearing before us. All the cases fixed before us for the entire week have been changed. Tell us details about it. <\/p>\n
She remarked committee has no such powers to transfer the case. <\/p>\n
The court issued contempt of court notice to additional registrar SC. <\/p>\n
SC while issuing show cause notice to additional registrar summoned reply along with minutes of meeting of judges committee.<\/p>\n
